License to Use

By downloading and using the iperf3 Client application, you receive a limited, non-exclusive, non-transferable, revocable license to use the application on your personal devices in accordance with these terms.

This license is granted solely for personal, non-commercial use. Commercial use of the application requires separate written permission.

Usage Restrictions

When using the iperf3 Client application, you agree NOT to:

• Use the application for illegal purposes or violation of third-party rights
• Abuse the application functionality to create excessive load on test servers
• Use automated means for mass testing without server owners' permission
• Decompile, disassemble, or attempt to obtain the application's source code
• Modify, adapt, or create derivative works based on the application
• Remove or alter copyright notices
• Use the application to conduct attacks or disrupt network services
• Resell or distribute the application without permission

Disclaimer of Warranties

The iperf3 Client application is provided "as-is" without any express or implied warranties, including but not limited to:

• Warranties of merchantability
• Warranties of fitness for a particular purpose
• Warranties of accuracy or completeness of results
• Warranties of uninterrupted or error-free operation

Limitation of Liability

To the maximum extent permitted by applicable law, we are not liable for:

• Any indirect, incidental, special, or consequential damages
• Loss of data, profits, or business reputation
• Business interruption or loss of functionality
• Any damages arising from use or inability to use the application

Our aggregate liability for any claims shall not exceed the amount paid by you for the application (if applicable).

Intellectual Property Rights

All rights to the iperf3 Client application, including but not limited to copyrights, trademarks, trade secrets, and other intellectual property rights, belong to the owner of chama.pro or its licensors.

The name iperf3 is a trademark of ESnet. Our application is an independent implementation of a client for the iperf3 protocol.

Changes and Updates

We reserve the right to:

• Modify, suspend, or discontinue the application at any time
• Update the application and introduce new features or restrictions
• Modify these terms of use with user notification

Continued use of the application after changes constitutes your acceptance of the updated terms.

Governing Law and Dispute Resolution

These terms of use are governed by the laws of the Russian Federation without regard to conflict of law provisions.

All disputes arising from these terms or related to the use of the application shall be resolved in courts at the location of the chama.pro owner after mandatory attempt at pre-trial settlement.
